Maryland Child Support
When the parents of a child do not reside together, a dispute regarding child support may arise. A parent can seek child support in a divorce proceeding, a custody proceeding, or an independent child support case. Child support can also be modified if the circumstances surrounding a prior child support award change in a material way.
The calculation of child support is primarily based on each parent’s gross income from all sources and the amount of overnights the child spends with each parent. Certain expenses paid directly by either or both parents are also taken into account in calculations.
In some cases, calculating child support is a straightforward process due to the Maryland Child Support Guidelines established by law. In other cases, calculating child support may be more complicated; for example, a child support case may be more complicated if the other parent attempts to conceal or misrepresent their income, if a parent is self-employed, or in cases where income exceeds the statutory guidelines.
