Insurance Law
Historically, the attorneys at Silverman Thompson have represented clients in a wide range of insurance coverage and liability issues. Our attorneys have successfully represented policyholders, carriers, risk retention groups, and insurance professionals in complex federal, state, and administrative matters.
Led by Partner Ned Parent, Silverman Thompson assists brokers, agents, producers, and other related entities in regulatory investigations and proceedings. These matters include not only before the Maryland Insurance Administration, but also in related proceedings in state and federal courts.
Additionally, parallel to his work leading Silverman Thompson’s renowned fiduciary litigation practice, Mr. Parent also actively litigates disputes over life insurance policies. Such disputes frequently echo the allegations and claims found in disputes amongst heirs in fights over estates and trusts, including capacity and undue influence. These disputes, though, often result in the insurance company initiating proceedings itself – known as interpleaders – in state and federal courts to compel the disputing parties to litigate their competing claims themselves.
Mr. Parent’s team at Silverman Thompson is thus uniquely equipped to guide their clients through such disputes, where they are able to combine their fiduciary litigation expertise with the insight gained through years working on insurance-related matters. Mr. Parent has secured multiple significant life insurance settlements on behalf of his clients without the need for prolonged litigation.
Some representative recent matters include:
- Mr. Parent led the defense of one of the country’s largest healthcare-sharing ministries before the Maryland Insurance Administration, specifically opposing an Administrative Order seeking the shutdown of his client’s operations in Maryland. After a nearly three-year fight, Mr. Parent’s efforts secured the withdrawal of this administrative order, allowing his client to continue operations in Maryland without any admission of wrongdoing or the assessment of any penalty.
- Mr. Parent successfully negotiated a resolution on behalf of a public adjuster under investigation by the Maryland Insurance Administration, allowing for him to maintain his license without an admission of liability.
- Mr. Parent is currently lead counsel representing a family who are victims of a $15 million life insurance fraud.
