Settlements & Agreements

Although family law matters are often contentious, parties can avoid or reduce the degree of conflict by cooperating with each other and remaining open to compromise.

There are several benefits to reaching an agreement with the other party. For example, parties and their attorneys can craft creative provisions addressing specific situations and your unique needs, and you can have a more direct role in shaping the terms.

Our team has vast experience in negotiating and drafting various agreements and settlements for family law matters. It is important to consult an experienced family law attorney to protect your rights and ensure the agreement is enforceable and satisfies all applicable requirements.

Prenuptial Agreements

A prenuptial agreement allows parties to establish the rights and obligations of the parties in the event of a divorce before entering into the marriage. Planning for a potential divorce can be an uncomfortable topic for a couple contemplating getting married; however, in many cases, proactive planning can help prevent future disagreement and protect each party’s assets. This is particularly true for individuals who have significant assets prior to marriage, own a business, or want to establish each party’s financial rights and obligations before getting married.

Our family law team at Silverman Thompson has vast experience with the negotiation and drafting of prenuptial agreements as well as defending or bringing actions to set aside prenuptial agreements, and can provide advice about your options.

Marital Settlement Agreements

A marital settlement agreement is a contract, which allows parties to resolve a divorce case by agreeing to terms resolving all issues arising out of the marriage, including but not limited to property distribution, alimony, and financial matters.

If the parties have children together, a marital settlement agreement can also address all issues related to the care, custody, access, and support of minor or dependent children. A marital settlement agreement signed by both parties allows you to seek an absolute divorce based on mutual consent, which is also sometimes referred to as an “uncontested divorce.”

Our family law team at Silverman Thompson has vast experience with the negotiation and drafting of marital settlement agreements as well as defending or bringing actions to set aside marital settlement agreements, and can provide advice about your options.

Parenting Plans

A parenting plan is a written agreement regarding how parties will care for and raise children as co-parents. Parenting plans generally address issues such as physical custody, parenting time, decision-making authority, and other terms. Parenting plans help set clear expectations and can reduce conflict between co-parents.

Our team can help you develop a parenting plan that prioritizes the well-being of your children and fosters positive co-parenting relationships.
